ケベック州では、1977年に制定された「フランス語法」(101号法)により、すべての子供は高等学校終了まで、原則としてフランス語で教育を受けなければならないと定めれている。英語で教育を受けるためには、上記法令に定める「資格<eligibility>」の条件を満たさなければならない。また、外国籍を持つ短期滞在者の子弟は、「一時的許可<temporary authorization>」によって、英語で教育を受けることができる。普通、日本から研究ビザ、就労ビザ等でケベック州に短期滞在する子弟のC.A.Q.がこれに当たる。
ケベック州はカナダの他の州とちがい、日本のカナダ大使館でStudent Visaを取得することはできないようです。従って親とともにケベック州に来る子弟はVisitor Visdaを取るか、親のVisaのdependentとして入国するようです。こちらでの入学手続きは大体以下のようです。
- 学校を決める。公立の場合は住所による学区があるようです。自分の住所からどの公立校に行けるかはSchool Boardできく。
- 学校の事務で入学したい旨伝え、何が必要かきく。Student Visaが必要と言われたら、以下の手順で手続きする。
- ScbooI Boardへ行き、English Schoolへ通える証明(English Eligibility)(Admissibilite L'enseignement en Anglais - Autorisation Temporaire)およびCAQ(Certificat D'acceptation du Quebec)のためのletterをもらってくる。(無料)
- ケベック移民局へ電話、または直接行き、インタビューの予約を取る。移民局の中に入るとすぐに案内の人がいるので予約を取りに来たと言うと右側の列に並ぶように言われる。受け付けでまた同じ事を言う。番号札をもらい待合いロビーで待つ。自分の番号が掲示板に表示されたら所定の部屋(2番)へ行き、また同じことを言う。ここでインタビューに都合のいい日時を決める。application formをくれる。(電話申し込みの場合は郵送)

ケベック移民局でインタビューを受ける。移民局の中の案内の人に予約済みであることを伝えると左側の列に並ぶように言われる。あとは4.と同様であるが、1階のcasherで100ドル払う。インタビューは2階で行われる。2階の受け付けでは書類(コピーのみ?)を提出する。書類がそろっていればインタビューは15分程度で終わり、その場でCAQが渡されるが、混んでいるとかなり待たされる。
- カナダ移民局へ行き、案内の人にStudent Authorization申請したい旨伝えれば、棚にあるappkcation formをくれる。銀行(National Bankなど)で所定の金額を支払う。application form + 銀行印のあるレシート + CAQなどの書類を郵送すると25日以内、にStudent Autborizationが郵送されてくる。
人により、学校により、CAQなしで通学した例、English Eligibilityすら必要なかった例、CAQが途中で切れて、1か月も登校禁止になった例(以前のcatholic school board管轄の小学校。)など様々です。従って、まず学校でどの書類が必要かをきくのが先決です。なお1998年7月からこれまでの宗教別(catholicとprotestant)から言語別(EnglishとFrench)のSchool Boardに再編されました。
以上はモントリオールの公立小学校入学の体験(1998年6月時点)よりまとめたものです。High School,French School,West IslandやMontreal島外、Private Schoolの場合は異なる点があると思われます。

Temporary Authorization
Children entitled to receive instruction in English under a temporary authorization fall into three broad categories:

the dependent children of persons living in Quebec temporarily to study or work, including:
-
the dependent children of foreign nationals who hold a Quebec certificate of acceptance or an employment authorization or a student authorization issued in accordance with the federal Immigration Act, or who are exempted from holding such a certificate or authorization under a statute applicable in Quebec;
-
the dependent children of Canadian citizens or permanent residents domiciled in another canadian province or a territory of Canada living in Quebec temporarily to study or work;
-
the dependent children of persons who are not Canadian citizens and who are posted in Quebec temporarily as representatives or officers of a country other than Canada or of an international organization;
-
the dependent children of members of the Canadian Armed Forces who are posted in Quebec temporarily.
The temporary authorization to receive instruction in English is delivered to the child and is valid for the same period as the immigration document issued to the parent or child or for the duration of the temporary stay as specified in a sworn declaration. It expires on June 30 of the school year in which the parent's or child's temporary stay ends.
A temporary authorization to receive instruction in English may be renewed provided that the applicant still meets the same criteria as in his or her first application.
However, the authorization cannot be granted to the children of foreign nationals who are claiming refugee status for themselves or their children, or of foreign nationals who choose to settle in Quebec on a permanent basis and obtain a Quebec selection certificate. If an authorization has already been granted, it expires on June 30 of the school year in which the selection certificate is delivered.
- The Application Process
To have a child declared eligible to receive instruction in English, the parent or legal guardian of the child must apply to the school board or private school where he or she wishes to enroll the child.
The parent or legal guardian must complete the appropriate application form and attach all of the required supporting documents. The child's birth certificate must be enclosed in all cases and must give the names of both parents. If a birth certificate cannot be provided, any other official document issued by a competent authority and attesting to the child's date of birth, sex and filiation will be accepted.
The school board or private school forwards the application and supporting documents to a person designated by the Minister of Education. This person will verify whether the child is eligible for instruction in English and will render a decision. The parent or legal guardian of the child will be informed of the decision within one to three weeks, depending on the time of year at which the application was made.
